1 General terms and conditions Terrazzza - Horse Park Festival
1.1 General conditions
The Terrazzza Horse Park Festival is a festival of HPF Entertainment AG, hereinafter referred to as the "organizer".By purchasing an admission ticket to the Festival, the purchaser accepts these General Terms and Conditions. The holder of a ticket, who has not purchased his ticket through the ticket providers designated by the organizer or has otherwise become the holder of a ticket, accepts these General Terms and Conditions at the moment he takes possession of the ticket.The Festival will take place in all weather conditions.The instructions of the organizer's staff must be strictly followed. Failure to do so will result in expulsion from the festival area without refund of the ticket price. The organizer reserves the right to take civil and criminal action.Access to the festival area is possible only with a valid ticket.The festival visitor agrees that he/she may be filmed and/or acoustically recorded as part of the audience and that these recordings may be used and exploited commercially and without compensation. He expressly and irrevocably waives the assertion of his personal rights in this regard.Festival visitors must be at least 20 years old.
1.2 Program
The organizer has no influence on the design and content of the artists' performances. The organizer assumes no liability in this regard.The organizer reserves the right to change the content and/or the program of the festival at any time and without prior notice.
1.3 Noise immission
At concerts, there may be a risk of possible hearing and health damage due to the volume. Hearing protection plugs will be handed out at the entrances to and at special locations on the festival site.The organizer declines any responsibility for possible damage to hearing or health.
1.4 Safety
The organizer's security service will carry out security and entry checks at all official entrances to and along the festival area and throughout the duration of the festival.The security service will carry out bag checks and body searches in consultation / cooperation with the local police authorities.The right to deny festival visitors entry to the festival area or to expel them from the festival area for good cause is reserved. If the festival visitor is not at fault, the organizer may, at its own discretion, refund the purchase price of the ticket. Non-compliance with these General Terms and Conditions constitutes an important reason.
2 Access and behavior on the festival area
2.1 Traffic
Parking on the access roads to the festival area and on the festival area (excl. festival parking areas) is strictly prohibited.Vehicles parked on the access roads or not on the festival parking area will be towed away without prior notice and at the owner's expense. The vehicle owner will be charged and must pay all expenses once the towing service has been ordered.Parking of vehicles is at your own riskPublic transportation is to be used whenever possible.
2.2 Entrance
The admission ticket must be exchanged for a control wristband at the official box offices and exchange stations of the organizer. The control bracelet is personal and non-transferable.Every person who enters the festival area (excl. festival parking lot) must wear the control bracelet tightly fastened around the wrist before entering.Damaged wristbands and wristbands that are not firmly fastened around the wrist do not entitle the holder to use the services of the organizer, in particular not to admission, and are invalid.Depending on the wristband, the control bracelet entitles the holder to enter the festival area.Lost tickets, free tickets or control bracelets will not be replaced.Persons who are on the festival area (excluding the festival parking lot) without a properly fastened wristband will be turned away and reported.The organizer reserves the right to change the admission times without prior notice. The organizer assumes no liability for delays at the entrance.The organizer reserves the right and may, at its sole discretion, temporarily block access for festival visitors to individual sectors on the festival grounds. This includes (but is not limited to) the outdoor area (or parts thereof), the riding hall 1 (arena stage) and the riding hall 2 (field stage). If individual sectors are temporarily closed, this does not result in a right to return tickets or a right to a refund (or partial refund) of the purchase price of the tickets.
2.3 Recordings
Picture, sound, film and video recordings of the artists performing at the festival are not permitted. Recordings for private use are generally permitted.The commercial use and exploitation of picture, sound, film and video recordings of the artists performing at the festival, of festival visitors or of the festival infrastructure is prohibited.Violations will be prosecuted under civil and criminal law.
2.4 Further rules
Prohibited items and animals in the festival area are:
• All kind of Glass Items / Bottles (incl. perfumes, deos)• Sun umbrellas, umbrellas and (flag) poles.• All firearms, spray weapons, stabbing weapons, percussion weapons and other objects classified as dangerous, in particular pocket knives (bag knives)• Cameras with digital or analog reflex cameras with/without interchangeable lenses, film and video cameras as well as audio recording devices• Selfie and GoPro sticks, etc.• Drones and other flight-capable devices, with or without cameras• Rollerblades, skateboards, kickboards, roller skates, bicycles, strollers, etc.• Pyrotechnic items, petards, dry ice• Household goods, sofas, etc.• Animals
Sleeping overnight on the festival area is generally prohibited.No fires may be lit on the festival area without the permission of the organizer.
TicketsTickets can only be purchased through the ticket providers designated by the organizer.
2.5 No right of return or refund
Under no circumstances shall there be a right to return the ticket or a right to a refund of the purchase price of the ticket.The festival visitors also acknowledge in particular that there may be changes in the lineup of the festival at any time, even at short notice; be it that performance times are postponed, be it that an artist does not perform at all. These and similar circumstances do not justify either a right to return the ticket or a claim for refund of the purchase price of the ticket.
2.6 Resale of tickets
The purchase of tickets for the purpose of resale is prohibited. The organizer will carry out appropriate checks and may block tickets purchased for the purpose of resale and declare them invalid. The organizer reserves the right to take civil and criminal action. A sale of an already purchased ticket can only be made on the "Fan-to-Fan" ticket resale sales pages provided, authorized and communicated by the organizer and the official ticket provider of HPF Entertainment AG.
3 Liability
To the extent permitted by law, any liability of the organizer for its own conduct and for the conduct of its auxiliary persons is excluded. In particular, the organizer and its auxiliary persons are not liable for bodily injury or financial loss caused to festival visitors by third parties (e.g. stand operators).The organizer is not responsible for lost or stolen items.
4 Final provisions
If the Festival has to be cancelled or postponed due to force majeure (e.g. war, death or illness of an artist, severe weather, catastrophes, riots, terrorist threat, warning or act, epidemics, pandemics, official ban or non-approval of the Festival through no fault of the Festival, etc.), there is no entitlement to the return of the ticket or to a refund of the purchase price of the ticket, but the ticket can only be exchanged for a ticket for the next edition of the Festival. In exceptional cases, the organizer may decide, at its own discretion and on a case-by-case basis, to refund the purchase price of the ticket instead, less a handling fee of 10% of the purchase price (maximum handling fee CHF 50.00). There is no entitlement to this.If the Festival has to be interrupted or cancelled due to force majeure, there is no claim to the return of the ticket, to the refund of the purchase price of the ticket or to the exchange for the next edition of the Festival. Interruption of the Festival is considered to be any temporary interruption of the Festival from the opening of the Festival (e.g. due to bad weather). Interruption of the Festival is considered to be any interruption of the Festival occurring after the opening of the Festival (e.g. due to an official ban).Changes to these General Terms and Conditions must be made in writing.There are no subsidiary agreements. The organizer reserves the right to change these General Terms and Conditions at any time. Amendments shall be deemed to have been accepted unless objected to within 30 days of publication.These General Terms and Conditions shall be governed exclusively by Swiss law, to the exclusion of its conflict-of-law rules and the Vienna Sales Convention. The place of jurisdiction for all disputes is exclusively Zurich, Switzerland.
5 General Terms and Conditions Online Portal
5.1 Terms
5.1.1 ONLINE PORTAL
www.terrazzza.com (hereinafter referred to as "online portal") is an information and service offering on the Internet.
5.1.2 OPERATOR
The operator of the online portal is HPF Entertainment AG (hereinafter referred to as the "Operator").
5.1.3 USER
Only natural persons who access and use the information and services of the online portal in accordance with the following General Terms and Conditions (hereinafter "GTC") are admitted as users of this online portal.
5.1.4 VISITORS
A visitor is any natural person who participates in an event organized and/or held by the Operator.
5.2 Information and service purpose
The purpose of the online portal is to provide information on the organization and implementation of events of all kinds, as well as the provision of services of all kinds in the areas of marketing, communication and advertising.
5.3 Usage
The use of the online portal is subject to these GTC. The user undertakes to use the online portal or the services available on it only for the intended purpose, to use it and thus in particular only to use it in such a way that no damage results to the operator. Likewise, the User undertakes to refrain from illegal use or use that violates these General Terms and Conditions.He further undertakes not to use any means to obtain materials or information that are not intentionally made available through the information and services or the online portal. In particular, the user is prohibited from using or manipulating texts, photos or videos of the online portal for his own or third party purposes.
5.4 Availability
5.4.1 GENERAL AVAILABILITY
The operator endeavors to provide the online portal with a high level of availability. However, an uninterrupted operation of the online portal cannot be guaranteed.
5.4.2 MAINTENANCE WORK
The Operator is entitled to carry out necessary or useful maintenance work on the OnlinePortal, which may lead to an interruption of the accessibility of the OnlinePortal and/or its functionality
5.5 Data backup
The Operator secures the data transmitted by the User. The User has no right to receive a copy of the data secured by the Operator. However, the right to information according to the Data Protection Act remains reserved. The User may request the Operator to delete his/her data at any time, specifying whether the deletion concerns the data for the delivery of the newsletter or the deletion of all his/her data. Such a request for deletion with the specific information must be made by e-mail to info@terrazzza.com.
5.6 Data protection
The operator is entitled to process the transmitted data within the framework of the statutory provisions and by the contractually agreed conditions. Data, which the user discloses to the operator via the online portal, is used exclusively for the purpose of raffles and for sending the newsletter (by e-mail or SMS). The operator does not pass on any data to third parties.
5.7 Safety
The operator as well as the user of the online portal shall take the necessary measures to ensure adequate security and to prevent unauthorized interference with their systems as well as the dissemination of harmful program code. The operator is entitled, but not obliged, to reject the receipt and sending of data, including e-mail and SMS, which contain harmful program code.
5.8 Remuneration
The information available on the online portal is provided by the Operator to the User free of charge.
5.9 Photos & Videos
The Operator may take or cause to be taken photographs and videos of the events organized and/or held by it, as well as of the visitors (individual persons or a group of persons) present there.
5.10 Publication
The operator may publish photos and videos on the online portal and on the profiles created for it on Facebook, Twitter and Instagram. Any person depicted may request the removal of the photo from the online portal in writing by e-mail (info@terrazzza.com) to the operator. The operator shall endeavor to comply with such requests as soon as possible.
6 Intellectual property rights
«Terrazzza» is a registered trademark of the Operator. All rights, titles and claims (including copyrights, trademarks, patents and other intellectual property rights as well as other rights) to, for and from all information and content (including all texts, data and graphics) accessible via the online portal remain with the operator.
7 Liability and indemnification
7.1 Disclaimer
The liability of the operator is excluded to the extent permitted by law. Consequently, the operator is only liable for damages caused to the user by intentional or grossly negligent conduct (Art. 100 para. 1 CO). The information on the online portal is carefully compiled. Nevertheless, the operator cannot assume any liability for the correctness, completeness, accuracy and timeliness of the information provided on the online portal. The operator is also not liable for information or content of external pages to which the online portal refers directly or indirectly. The information and content published on the online portal are for information purposes only.Under no circumstances shall the operator be liable for damages resulting from interruptions and malfunctions due to circumstances beyond the operator's control, such as interruptions and malfunctions of the telecommunications connection, interruptions and malfunctions due to harmful program code, interruptions and malfunctions due to force majeure, etc. The operator shall not be liable for damages resulting from interruptions and malfunctions due to force majeure.The exclusion of liability applies to both contractual and non-contractual or quasi-contractual claims.
7.2 Exemption
The User indemnifies the Operator from any liability and from any damages, if third parties assert claims against the Operator, which are due to the use of the online portal or the service by the User not in accordance with the contract.
7.3 Further provisions
7.3.1 SCOPE
These GTC apply to any natural person who is either a user of the OnlinePortal or a visitor to an event organized and/or held by the Operator.
7.3.2 MODIFICATION
The operator reserves the right to change these GTC at any time. Changes will be made available on the online portal and come into force with their publication.
7.3.3 SEVERABILITY CLAUSE
Should individual provisions of these GTC be invalid or incomplete or should performance become impossible, this shall not affect the validity of the remaining parts of the contract.
7.4 Place of jurisdiction and applicable law
The place of jurisdiction is the registered office of HPF Entertainment AG. Swiss substantive law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
